Simx Ltd offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

Our store is hosted on www.smartvent.co.nz. This is the online e-commerce platform that allows us to sell our products and services to you through our accredited installer network.
All purchases are channelled through SmartVent Accredited installers. Simx Ltd is operating as an agent for Accredited Installers and all payments are collected on behalf of Accredited installers.
SECTION 1 – ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority, or that you are the age of majority and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your order.

We reserve the right to refuse service to anyone for any reason at any time.

We reserve the right but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
We warrant all goods are of acceptable quality, fit for purpose and match the description. All purchases are covered by the Consumer Guarantees Act. The warranty information is detailed in the product documentation.
Product availability will vary, and this may affect delivery. The timeframe for the supply of the product is normally within four weeks from the purchase date. Simx Ltd is not liable for any cost or inconvenience caused if delivery is not possible within the standard delivery time.
SECTION 6 – ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. If we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates so that we can complete your transactions and contact you as needed.

SECTION 7 – RETURNS POLICY
To return products first visit https://simx.co.nz/warranty-request
Submit a Return Request Form online to receive an authorisation number via email.
Print a copy of your email (Return Request Form including authorisation number).
Return the product to your supplier, or place of purchase, with the following documentation:
– original proof of purchase,
– a copy of the completed Return Request Form,
– and the authorisation number (which has been provided when the Return Request Form was submitted)
If the product is covered under warranty and is deemed faulty by the manufacturer, it will be repaired, or replaced, and then returned to your supplier.
Your supplier will contact you to advise the product is ready to be collected.
If the product selected is not suitable for the home and is returned to Simx Ltd in ‘as new’ condition within 28 days from the date of purchase, we will consider refunding the full purchase price, excluding any shipping costs.

SECTION 8 – THIRD-PARTY PRODUCT DELIVERY AND OPTIONAL INSTALLATION
All payments for products purchased through this website are collected for, and on behalf of the Accredited Installer you select at checkout.
The selected Accredited Installer will, at their discretion, deliver product to your address or arrange it to be available for you to collect from their business premises or preferred electrical supplier. All sales are made on the basis that shipping to your address is not included, i.e. click and collect from a central location, unless stated otherwise. If you require delivery to your physical address shipping should be arranged directly with the accredited installer.
If you request an installation quote, the accredited installer, subject to availability, may deliver the purchase at the time of quote, free of charge. If you prefer to take delivery of the product at this time, please ensure this is clearly communicated with the Accredited Installer.
Any additional cost associated with delivery to your address is not included in the price.
You may select to install your purchase using the listed Accredited installer selected at checkout.
You acknowledge and agree that we provide details of the Accredited Installer “as available” without any warranties, representations, or conditions of any kind or endorsement. We shall have no liability whatsoever arising from or relating to your use of the accredited installer to install your purchase. We do not guarantee your selected Accredited Installer will be able to install your purchase, furthermore, the responsibility to ensure the purchase is fit for your purpose is entirely at the purchaser’s discretion.
Any use by you of an Accredited Installer offered through the site is entirely at your own risk and discretion. You should ensure that you are familiar with and approve of the terms on which products are provided by the relevant third-party provider.
We may also, in the future, offer new services and/or features through the website. Such new features and/or services shall also be subject to these Terms of Service.

Providing some information is optional. If you choose not to enter your home address or contact details, we will be unable to perform a home assessment or warranty repair. If we collect information from you not related to your property, such as personal financial information for an online finance application, we do not retain this information once the application is completed.
You have the right to ask for a copy of any personal information we hold about you, and to ask for it to be corrected if you think it is wrong.
